Provided e-gift card is non-transferable, non-refundable and holds no cash value.

 

Uber Eats, Grubhub & Door Dash are virtual marketplace platforms that connects hungry diners with third-party service providers, including local restaurants and independent delivery service providers. You may order food through one of the platforms to be delivered from particular restaurants, including their authorized licensees and franchisees, or other purveyors of food in cities throughout the United States. The Platforms will be referred to "food delivery service" for the purposes of the is agreement.

"Sponsor", Events by M, Ltd and your chosen food delivery service assumes no responsibility and is not liable or responsible for Restaurants' food preparation or safety and does not verify their compliance with all applicable laws. In addition, "Sponsor", Events by M, Ltd and your chosen food delivery service does not guarantee the quality of what the Restaurants sell, nor does it guarantee the services provided by them, including, without limitation, in those cases where they provide the delivery services or engage another third-party delivery service. "Sponsor", Events by M, Ltd and your chosen food delivery service does not independently verify, and is not liable for, representations made by restaurants regarding their food, including, without limitation, any menu or restaurant-level descriptors or disclosures.

 

The intent of the food delivery service e-card is utilization for food delivery only not permissible for alcoholic beverages. Some jurisdictions permit the ordering and delivery of alcoholic beverages, "Sponsor", Events by M, Ltd ask that you decline the e-card if you intend to utilize the e-card for alcoholic beverages. In such jurisdictions, if you place an order that includes any alcoholic beverage, you represent and warrant that you are at least 21 years of age. Upon delivery or pickup, as applicable, you shall present a government-issued identification card, evidencing your age, consistent with applicable legal requirements. You also agree that delivery of the alcoholic beverages may be withheld if you appear or the recipient of the delivery appears intoxicated when receiving delivery of such products. If you do not comply with these terms, you agree that the alcoholic beverage(s) will not be released to you, and you may forfeit the cost of such beverages.

 

Your conduct, by accepting the e-card and accessing food delivery services, you agree to:

Comply with the agreement and all applicable laws, rules and regulations in connection with your use of the food delivery services, including, without limitation, laws regarding online conduct and your conduct (as defined below); not to access the food delivery service using a third party's account/registration without the express consent of the Account holder and not to attempt to impersonate another user or person; not to copy, publish, or redistribute any coupon or discount code or act in bad faith in an attempt to manipulate or gain an unintended commercial benefit from incentive offers; not to harass, annoy, intimidate, or threaten any food delivery service employees, contractors, or agents engaged in providing any portion of the services.

You agree to comply with the above conduct requirements, and agree not to assist or permit any person in engaging in any conduct that does not comply with the above conduct. You are accepting the food delivery service e-card of your own free will.

Acceptance of the food delivery service e-card is not mandatory. You agree to release "Sponsor", Events by M, Ltd and your chosen food delivery service of any responsibility and/or liability of any occurrence as a result of the acceptance of the e-gift card and the associated services and interaction with personnel from food delivery service and their associates, consumption of food and beverage, not limited to food poisoning, illness, injury and/or death.
